Child Custody
At the time of divorce, determining child custody can be very emotional and distressing for everyone involved. The court will base its decisions on the best interests of the children.
"Physical custody" describes where the child primarily resides. "Legal custody" is the authority to make decisions about the child's health care, religious upbringing, education and welfare. "Parenting time" which many people call "visitation," is a term used to describe the time each parent has with the child.
Joint custody arrangements generally refer to shared legal custody. When it comes to physical custody, in most cases one parent has primary custody, with the child living primarily in that parent's home. Visitation Schedules and Your Rights

In mediation or a court hearing, a third-party child custody evaluator is typically brought in to evaluate you and the other parent in order to determine the best interests of your children.
The court will make its decision largely based on the evaluator's recommendation, although additional evidence can be presented to the court. Some child custody evaluators may not be able to provide an objective, skilled reading of the family relationships. Having a lawyer who understnds your side of the story can help offset any unclear or unfavorable recommendations.
If needed, we can help you find an independent evaluator or psychologist for your children. We can also do alcohol assessments if alcohol abuse may be a factor.
