Defending Against a Restraining Order Petition
Having a restaining order on your record can affect other areas of your life, such as your employment and your child custody or visitation arrangements. If you have been notified of a temporary protective order against you, or if someone has requested a hearing for a permanent order, you do have the right to defend yourself. There are three ways to resolve an order for protection. You can:
- Deny the Allegation: the court will hold an evidentiary hearing (trial) and determine, based on the evidence at the hearing, whether or not there was abuse.
- Admit to the allegations and allow the order to go through
- Refuse to admit to the allegations and allow the order to go through: the court will not make any findings about whether or not abuse happened and will order you to avoid contact with the other party.
Which of these options you choose depends on the alleged incident. In order for the court to grant a permanent restraining order, the other party must show there was actual physical harm, interference with a 911 call, a reasonable fear of imminent danger, or credible threats against the other party's life.
