What is Mediation?
Mediation is a form of Alternative Dispute Resolution (ADR) that is confidential and most commonly used in resolving family law conflicts. Mediation is a voluntary process and gives the parties the power to create an agreement resolving all issues including custody, child support, parenting time, spousal maintenance and division of marital property tailored to their family. Studies have proven that parties who negotiate a settlement agreement are less likely to return to Court on post-decree motions.
Mediation is a cost effective way to resolve some or all of your family law issues. However, mediation may be inappropriate for parties who have been victims of domestic violence. The neutral third party is qualified under Rule 114 to mediate. The process is confidential and the mediator cannot be a witness at trial.
What is the cost of Mediation?
The cost of mediation is usually split between the parties unless otherwise agreed upon. The fee for the initial mediation session is $500. This fee covers the review of the informational forms, and documents provided by the parties, two (2) hour mediation session, and the mediator's written summary of agreements reached in mediation. Should the parties need additional time or another session, the hourly fee is $190.00.
